Question on the Ballot
The Council of The Regional Municipality of Durham passed By-law No. 20-2010 on the 21st day of April, 2010 to submit a question to the electors in all lower-tier municipalities in The Regional Municipality of Durham at the next regular municipal election to be held on October 25, 2010. Candidate Nomination
Starting Monday, January 4th, 2010, qualified individuals may register with the Township of Uxbridge to run for the following local government offices:
- Mayor - One (1) member to be elected by general vote
- Regional Councillor - One (1) member to be elected by general vote
- Ward Councillors - Five (5) members to be elected by the electors of each of the five (5) Wards in the Township of Uxbridge

- One (1) Trustee to be elected to represent the combined area of Townships of Uxbridge and Brock

- One (1) Trustee to be elected to represent the combined area of the Regional Municipality of Durham, the Counties of Haliburton, Northumberland, Peterborough and the City of Kawartha Lakes

Candidate Qualifications
To qualify to be elected for the position of Mayor, Regional Councillor or Ward Councillor you must be:
- 18 years of age;
- a Canadian citizen; and,
- a resident of the Township of Uxbridge or the owner or tenant of land in the Township of Uxbridge or the spouse of such owner or tenant
In addition, you must not be:
- ineligible or disqualified under the Municipal Elections Act, 1996, as amended, The Municipal Act, 2001, as amended, the Municipal Conflict of Interest Act or any other Act to be elected to or hold the above-mentioned office.
- an employee of the Corporation of the Township of Uxbridge. If you are an employee, you must take an unpaid leave of absence as described in Section 30 of the Municipal Elections Act, 1996, as amended.
- a judge of any court.
- a member of the Assembly as provided in the Legislative Assembly Act or of the Senate or House of Commons of Canada. If you are, you must provide proof of your resignation in a form satisfactory to the Clerk of the Corporation of the Township of Uxbridge prior to 2:00 p.m. on Nomination day, September 10, 2010. The Clerk of the Corporation of the Township of Uxbridge will reject your nomination for the above-mentioned office if you fail to provide proof of resignation by this deadline.
- a member of the Executive Council of Ontario or a federal Minister of the Crown.
- a Crown employee within the meaning of the Public Service Act. If you are a Crown employee, you have followed and will continue to follow all the relevant provisions of Part III of such Act.
- prohibited from voting at the municipal election under subsection 17(3) of the Municipal Elections Act, 1996, as amended.
- a person who is serving a sentence of imprisonment in a penal or correctional institution.
- a person who was convicted of a corrupt practice described in subsection 90(3) of the Municipal Elections Act, 1996, as amened, during an election that occurred less than four years prior to Monday, October 25, 2010.
- a candidate who was convicted of a corrupt practice under the Municipal Elections Act, 1996, as amended, or of an offence under the Criminal Code (Canada), in connection with an act or omission with respect to a municipal election if the Voting Day in that election is less than eight (8) years prior to Monday, October 25, 2010; and,
- disqualified from being elected to or holding office by reason of any violations of the election campaign financial requirements or violations for not filing the financial statement pursuant to the Municipal Elections Act, 1996, as amended.
Nomination Procedures
- A nomination must be signed by the candidate and may be filed by the candidate or his/her agent, in person, on or before Nomination Day, September 10th, 2010, during regular business hours, Monday through Friday, 8:30 a.m. until 4:30 p.m. On Nomination Day, nominations may be filed between the hours of 9:00 a.m. and 2:00 p.m., only.
- A prescribed nomination-filing fee of $200.00 must accompany the nomination form for the office of Mayor and a nomination-filing fee of $100.00 must accompany the nomination form for the office of Councillor or School Trustee. The fee is refundable if the candidate withdraws his/her nomination under Section 36 of the Municipal Elections Act, 1996, as amended, or if he/she receives more than 2% of the votes cast for the office to which he/she is nominated.
- A nomination must be certified by the Clerk before such person becomes a certified candidate for the office to which he has been nominated.

You must satisfy all of the following qualifications at the time you register your nomination for a Council position:
- Live in the Township of Uxbridge, be the owner or tenant of land there, or be the spouse or same sex partner of such owner or tenant;
- Be a Canadian citizen; and
- Be at least 18 years of age.
- You must not be statutorily disqualified from registering.
- School board candidates must live within the boundary of the applicable school board, but do not have to live within the Township of Uxbridge municipal boundaries.
In the event there is an insufficient number of certified candidates to fill all positions available, nominations will be re-opened for the vacant positions, only, on Wednesday, September 15th, 2010, between the hours of 9:00 a.m. and 2:00 p.m. Such additional nominations, if required, shall be filed in the office of the Clerk as set out above.
Electors are hereby given notice that if a greater number of candidates are certified than are required to fill the said offices, voting will take place.
Campaign Contributions
The following may make contributions to a candidate's campaign:
- An individual who is normally a resident of Ontario;
- A corporation that carries on business in Ontario;
- A trade union that holds bargaining rights for employees in Ontario;
- A candidate and his or her spouse (subject to Section 70(5), MEA, if not normally a resident in Ontario, a candidate and his or her spouse may make contributions only to the candidate's election campaign).
The following shall not contribute to a campaign:
- A federal political party registered under the Canada Elections Act or any federal constituency association or registered candidate in a federal election;
- A provincial political party, constituency association, registered candidate or leadership contestant registered under the Election Finances Act;
- The Crown in right of Canada or Ontario, a municipality or local board.
No contributor shall make a contribution exceeding $750 to any one candidate in an election. This limit is never to be exceeded regardless of the number of offices a candidate may have been nominated for during an election period. In addition to this, a contributor shall not make contributions exceeding a total of $5,000 to multiple candidates for office on the same council or local board. Cash contributions of $25 or more, are not to be accepted by candidates.
Vote by Mail Information
As in previous Municipal Elections, the Township of Uxbridge is conducting the 2010 Municipal Election as a mail-in election. Each eligible elector included on the Voters' List, as of September 15th, 2010 will receive a Mail-in Vote Kit by mail on or after October 1st, 2010.
Electors may return their ballot and voter declaration form to the Township of Uxbridge by any one of the following means:

By Mail
Prepaid Yellow Return Voting Envelope will be provided in the Mail-in Vote Kit. The last day to mail your ballot and declaration in order to ensure that it is received by the October 25th deadline is October 16, 2010. -
Ballot Return Station
In addition to using the regular mail system, a "Ballot Return Station" will be established for those electors wishing to deposit or have deposited their Yellow Return Voting Envelope directly to the Clerk or designated election official at the Township of Uxbridge Municipal Office, 51 Toronto Street South, Uxbridge, Ontario on the following dates and times:
Monday, October 4th, 2010 to Friday, October 22nd, 2010 from 8:30 a.m. to 4:30 p.m. and
Monday, October 25th, 2010 from 8:30 a.m. to 8:00 p.m.
Extended office hours will be as follows:
Saturday, October 16th, 2010, from 10:00 a.m. to 4:00 p.m.
Wednesday, October 20th, 2010 and Thursday, October 21st, 2010 from 4:30 p.m. to 7:00 p.m. -
Hand Deliver
Depositing the completed Yellow Return Voting Envelope in the green mail box located at the front of the Township of Uxbridge Municipal Office, 51 Toronto Street South, Uxbridge, Ontario prior to 8:00 p.m. on Voting Day, October 25th, 2010 will be considered as having been mailed.
For those electors wishing to deposit their ballots and declarations at the Ballot Return Station, you are encouraged to do so prior to the evening of October 25th, 2010 in order to avoid line ups.

What is 'Mail-in Voting'?
Mail-in Voting is a method of conducting elections. Instead of using traditional polling places where voters go to cast ballots on Election Day, a ballot is mailed to each qualified elector who is on the Voters' List. The ballot is then marked, placed in a secrecy envelope and returned to the Township Clerk, either by regular mail or personal delivery.

Who May Vote?
Any person who, on Election Day, meets the following qualifications is eligible to vote:
- Is a Canadian Citizen;
- Is at least 18 years old on Election Day;
- Resides in the municipality or is the owner, tenant, or spouse, or same sex partner of the owner or tenant of land;
- Any person not prohibited, by law, from voting.

When are the ballots mailed to the voters?
On or about October 1st, 2010, a complete Mail-in Voting Kit will be mailed to all qualified electors whose addresses are shown on the Voters' List, as at September 15th, 2010.

What if my name is not on the Voters' List?
- You may be added to the Voters' List from September 7th, 2010 until the close of voting at 8:00 p.m. on October 25th, 2010;
- You must attend at the Municipal Clerk's Office and complete a prescribed form to have your name added to, removed from or information corrected on the Voters' List.

How do I receive my Mail-in Voting Kit?
- Any person added to the Voters' List up to September 15th, 2010, will receive their Mail-in Voting Kit in the regular mail.
- Persons added to the Voters' List from September 16th, 2010-October 1st, 2010, will have their Mail-in Voting Kit sent to them by the Clerk on or after October 4th, 2010.
- Persons added to the Voters' List after October 1st, 2010, may pick up their Mail-in Voting Kit during regular office hours at the Township of Uxbridge Municipal Office at the time they are added to the Voters' List.

What will be contained in the Mail-in Voting Kit?
- Voting Instruction Sheet
- One Composite Ballot
- One Ballot Secrecy Envelope
- One Voter Declaration Form
- Yellow Return Voting Envelope with prepaid postage
- Such other material as the Clerk or designated election official determines.

What do I have to do when I am ready to complete my Mail-in Voting Kit?
- When you have decided on how you wish to vote, you complete the ballot and place it in the Ballot Secrecy Envelope.
- You then sign the Voter Declaration Form and place it in the Yellow Return Voting Envelope together with the SEALED Ballot Secrecy Envelope.
- DO NOT WRITE ON THE BALLOT SECRECY ENVELOPE.
- The voter's signature must appear on the Declaration Form or the ballot will not be counted.

What if I forgot to sign the Voter's Declaration Form OR omitted it from the Yellow Return Voting Envelope?
You MUST sign the Voter's Declaration Form and place it in the Yellow Return Voting Envelope. If you do not, your vote will be rejected.

What if I did not receive my Mail-in Voting Kit OR I make a mistake marking my ballot?
If you did not receive a Mail-in Voting Kit, have lost or inadvertently discarded it or have made a mistake marking your ballot, you may receive a replacement kit at the Township of Uxbridge Municipal Office. You will be required to sign a declaration stating that you have not already voted in this Election.

What is the last date that I can mail my ballot to the Municipal Clerk?
- The final day for depositing the Yellow Return Voting Envelope in the mail to ensure delivery to the Municipal Clerk by Election Day is October 16th, 2010. Following this date voters are encouraged to deposit their Yellow Return Voting Envelope at the Ballot Return Station at the Township of Uxbridge Municipal Office, 51 Toronto Street South, Uxbridge or in the green mail box located at the front of the Township of Uxbridge Municipal Office.
- Your Yellow Return Voting Envelope can be deposited at the Ballot Return Station or in the green mail box until 8:00 p.m. on October 25th, 2010 (Voting Day).

Where are the results of the election being posted?
Unofficial results will be posted in the Uxbridge Arena Community Centre, 291 Brock Street West, Uxbridge on Monday, October 25th, 2010, after 8:00 p.m. The public is welcome to attend and see the results.

Unofficial Results will be posted on the Municipality's web site after 8:00 p.m., October 25th, 2010.
